Terms of Service
Last updated: 21 October 2026
These terms govern the use of Switchgear, a communications and verification platform operated by Brivo Synaptics ("we", "us"), a company registered in Zambia. By creating an account or using the Switchgear API, portals or websites, the business you represent ("you") agrees to these terms. If you accept them for a business, you confirm you are authorised to bind it.
1. The service
Switchgear lets businesses send and receive messages and verify people over SMS, email, WhatsApp, push notifications and USSD through one API. We deliver through third-party providers such as mobile network operators, SMS gateways, Meta's WhatsApp Business Platform, email providers and Google Firebase Cloud Messaging. Features may differ between the sandbox and production environments and may change over time.
2. Accounts and approval
- You must give accurate information and keep it up to date.
- Sandbox use starts straight away. Production use starts only after we approve your business. We may ask for registration documents, tax details and sender-ID or template approvals from providers, and we may decline or withdraw approval.
- You are responsible for everything done with your account and API keys. Keep keys secret, give access only to people who need it, and tell us at once if a key may have been exposed.
3. Your responsibilities to recipients
- Only contact people who have agreed to hear from you, or with whom you have another lawful basis, and keep records of that.
- Honour opt-outs promptly. Switchgear enforces the suppression lists you and recipients create, and you must not try to get around them.
- Say clearly who you are in every message.
- You are the controller of your recipients' personal data, and you must comply with the Data Protection Act No. 3 of 2021 and any other law that applies to you. We process that data on your behalf as described in our Privacy Policy.
4. Acceptable use
You must not use Switchgear to:
- send spam, unsolicited bulk messages or messages to purchased or scraped contact lists;
- send fraudulent, deceptive, threatening, harassing, hateful, sexually explicit or otherwise unlawful content, including phishing and impersonation;
- promote illegal goods or services, or gambling, lending or other regulated activities without the required licences;
- break the rules of the networks and providers we use, including the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, operator sender-ID rules and Google's Firebase terms;
- attempt to breach, overload or reverse-engineer the platform, or test its security without our written permission.
Providers may block, filter or delay messages independently of us. We may block a message, suspend a key or suspend your account if we reasonably believe your use breaks these terms, the law or a provider's rules, or puts the platform or other customers at risk. Where we can, we will tell you first.
5. Fees and payment
- Production use is charged according to your plan and the price list shown in your account. Prices are in Zambian kwacha unless agreed otherwise.
- Prepaid accounts pay from a wallet balance. When the balance runs out, sending stops until you top up. Postpaid accounts, where we approve them, are invoiced monthly and must pay by the due date.
- Charges apply when a provider accepts a message, whether or not it is ultimately delivered, unless your plan says otherwise.
- We may change prices with at least 30 days' notice. Sandbox use is free within its limits.
- Fees exclude applicable taxes, which are added where required.
6. Availability
We work to keep Switchgear available and reliable, but we do not guarantee uninterrupted service or the delivery of any particular message. Delivery depends on networks, providers and recipients' devices, which we do not control. We may carry out maintenance, and we will try to announce planned downtime in advance.
7. Your content and data
You keep all rights to the content and data you send through Switchgear. You give us permission to process them only to provide, secure and support the service, and as the law requires. You are responsible for your content and confirm you have the right to send it.
8. Our platform
Switchgear, its software, documentation and brand belong to Brivo Synaptics. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is active. Feedback you give us may be used to improve the service without obligation to you.
9. Confidentiality and security
Each party will protect the other's confidential information with reasonable care and use it only for the purposes of these terms. We protect personal data as described in our Privacy Policy and will notify you without undue delay of a security incident affecting your data.
10. Liability
- The service is provided "as is" and "as available". To the extent the law allows, we exclude implied warranties.
- Neither party is liable for indirect or consequential losses, or for lost profits, revenue or data.
- Our total liability under these terms in any 12-month period is limited to the fees you paid us in that period.
- These limits do not apply where the law does not permit them, or to your payment obligations or your breach of section 4.
You agree to compensate us for claims by third parties, including recipients, regulators and providers, that arise from your content, your messaging practices or your breach of these terms.
11. Ending the agreement
You may close your account at any time. We may end these terms with 30 days' notice, or immediately for a serious breach. When an account closes, sending stops, any unused prepaid balance is handled as your plan describes, and we delete or return your data as set out in our Privacy Policy, except what the law requires us to keep.
12. Changes to these terms
We may update these terms. We will post the new version here and, for material changes, notify account owners at least 30 days before they take effect. Continuing to use Switchgear after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of the Republic of Zambia. The parties will first try to settle any dispute in good faith. If that fails, the courts of Zambia have jurisdiction.
